SCHENECTADY — A civil jury in Schenectady County has awarded $600,000 to a pedestrian who was struck by a car and injured in Rotterdam in 2019.
Michelle E. Dyer, 47, had been walking on Fort Hunter Road when she was struck by a vehicle being driven by Edwin A. Agresta on July 17, 2019, according to the firm of O’Connell & Aronowitz, whose attorney, Stephen Coffey, represented the plaintiff.
Dyer suffered serious injuries, including multiple fractures in her left forearm and suffers from post-traumatic stress disorder, a news release from the firm said.
The lawsuit, filed in July 2021, went to trial before state Supreme Court Justice Michael Cuevas on March 21. Jurors rendered their verdict on March 24. The panel initially awarded Dyer $800,000, then lowered it to $600,0000. It determined that Dyer was 25 percent comparatively negligent, the release said.
“I’m pleased that we were able to secure a substantial cash settlement for Ms. Dyer, who suffered a number of painful injuries that will likely remain with her for years to come,” Coffey said in a statement.
Dyer was additionally represented by Olivia S. Lupoli, who is with the Law Offices of Sanford Rosenblum in Albany.
Agresta was represented by the firm of Horigan, Horigan & Lombardo in Amsterdam.
