POUGHKEEPSIE – Dutchess County Court Judge Edward McLoughlin sentenced a repeat offender to prison for his role in a robbery combined with drug possession. Joseph Faircloth, 40, of Schenectady was sentenced to a maximum of 22 years in prison for his actions in July 2022.
Faircloth had robbed a man at gunpoint in the Manchester Gardens apartment complex in the Town of Poughkeepsie on July 15, 2022. He then fled to his daughter’s residence to hide his gun. Faircloth’s daughter then attempted to drive her father to a safe location when they were involved in a car accident at Main Street and Taft Avenue. When Faircloth was arrested, he had 1,250 mg of PCP in his pocket. The robbery netted Faircloth $40 in cash, which he also had with him.
County Senior Assistant Public Defender Alex Rosen argued for leniency on behalf of his client.
As a result, Faircloth was sentenced to three-and-one-half to seven years on the robbery charge and 15 years in prison for the drug charge. The sentences are to run consecutively, meaning that his total sentence is 15-and-one-half years to 21 years behind bars. He must also serve five years of post-release supervision.
If Faircloth had been sentenced under the repeat violent felony guidelines, he would have faced a sentence of 20 years to life in prison.
