Watchdog probing NYPD decision not to immediately arrest ex-Marine in Jordan Neely killing – New York Daily News

A police watchdog agency is looking into a complaint alleging the NYPD acted wrongly in not immediately arresting Daniel Penny for the chokehold death of Jordan Neely, officials said.

The Civilian Complaint Review Board said it received the complaint about the deadly May 1 encounter in which Penny, a former marine, placed Jordan Neely, a mentally ill homeless man, in the chokehold on an F train near the Broadway/Lafayette station.

Penny, 24, was initially questioned by the NYPD and released without charges after the encounter.

He turned himself in Friday morning at the 5th Precinct stationhouse in Chinatown to face second-degree manslaughter charges filed by the Manhattan District Attorney’s office for fatally choking Neely, 30.

“He did so voluntarily and with the sort of dignity and integrity that is characteristic of his history of service to this grateful nation,” his lawyer, Thomas Kenniff, told reporters earlier. “The case will now go to court.”
