Syracuse judge who refused to marry same-sex couple will stop hearing criminal cases for now, officials say

Syracuse, N.Y. – A Syracuse judge facing backlash for refusing to marry a same-sex couple will recuse herself from criminal cases while there is a pending grand jury investigation against her, court officials said Friday.

Judge Felicia Pitts Davis is “temporarily” recusing herself from all cases involving the Onondaga County District Attorney’s Office, Deborah Karalunas, the Administrative Judge for the Fifth Judicial District, said in a statement.

Pitts Davis recused herself to “avoid the appearance of impropriety,” Karalunas said in a statement released by a state court spokesperson. She will be assigned to civil cases while the matter is pending, Karalunas said.

A grand jury is hearing evidence presented by the district attorney’s office to determine whether Pitts Davis should be charged with a crime.

Shawntay Davis, 33, and Niccora Davis, 29, told syracuse.com | The Post-Standard that they were asked to testify before a grand jury about the incident Wednesday.

District Attorney William Fitzpatrick has declined to comment on whether there is a grand jury looking into Pitts Davis. Grand juries are secret in New York state.

The Syracuse City Court judge’s decision to step back from criminal cases comes a week after Fitzpatrick told syracuse.com | The Post Standard that he planned to ask her to recuse herself.

“You shouldn’t have to walk into the court and wonder, ‘Am I getting a fair shake?’” Fitzpatrick said.

Pitts Davis refused to marry the couple on Nov. 16 after performing a marriage for a heterosexual couple in the same courtroom moments before, two sources told syracuse.com.

The couple said that Pitts Davis was emotional during the wedding she conducted and then left without acknowledging them.

Pitts Davis cited her religious beliefs as the reason she refused to marry the two women, sources said. Syracuse City Court Judge Mary Anne Doherty, who is gay, performed the marriage ceremony instead.

Former Jreck Subs owner, jailed for fraud, has sentence commuted by President Biden

Watertown, N.Y. — President Joseph R. Biden on Thursday commuted the sentence for convicted fraudster and former Jreck Subs principal Christopher M. Swartz.

In 2017, Swartz, of Watertown, was convicted of defrauding over 150 people out of about $21 million, and evading over $4 million in taxes.

According to a press release from the U.S. Department of Justice released after his sentencing, Swartz had taken money from people interested in investing in the sandwich shop chain and other hospitality companies he owned, providing fraudulent promissory notes and offers of ownership in his companies.

When people attempted to get their money back, he made false assurances and partial payments, ultimately concealing his assets in a web of shell companies and secondary accounts to hide the money from those he owed money to. He did this between 2005 and 2015.

He pleaded guilty in 2016 to wire fraud and tax evasion counts.

He also sold worthless shell company stocks to about 70 people in the U.K., defrauding them of about $1.1 million.

“Christopher Swartz stole millions of dollars from investors and lenders and cheated the public treasury out of millions of dollars of taxes,” said Acting U.S. Attorney Jaquith at the time of his sentencing. “His elaborate scheme to defraud relied on a mind-boggling web of accounts and enterprises and concealment of his assets and diversions of funds.”

He was sentenced to 150 months in federal prison for the fraud and tax evasion, and was serving his time in the Otisville prison in Orange County. But in December of 2022, Swartz was relocated from the prison to a halfway house in Pittsburgh, meant to aid a transition out of the corrections system. He served just over 5 years in prison of his original 12 1/2 -year sentence.

Collision between vehicle and dirt bike in Syracuse leaves 2 injured

Syracuse, N.Y. — A person is in critical condition after a vehicle and dirt bike collided Thursday afternoon, police said.

The crash happened in the 200 block of Walrath Road around 4:06 p.m., according to Kieran Coffey, a spokesperson for the Syracuse Police Department.

The person riding the dirt bike was taken to Upstate University Hospital and is in critical condition, he said. The driver of the vehicle was also taken to Upstate University Hospital for leg injuries.

Tom Brady says Bills’ Josh Allen has one thing he wishes he had during playing days

Tom Brady is a seven-time Super Bowl champion and a five-time Super Bowl MVP. He was league MVP multiple times, a six-time All-Pro and a 15-time Pro Bowl player. His list of accolades go on and on so when the former New England Patriots and Tampa Bay Buccaneers quarterback says he is envious of another quarterback it catches your attention.

On Sunday, that’s exactly what happened during the Buffalo Bills’ 31-10 win over the Seattle Seahawks. With Brady calling the game in the booth, Bills quarterback Josh Allen moved the chains on a 4th-and-1 quarterback sneak, a play he has had great success with throughout his career.

Despite Seahawks being ready for the play, Allen was able to pick up the first down thanks to his lower body strength. Brady, however, had a more interesting way of describing Allen’s success on the play.

“That’s a big boy with the big powerful legs and a big powerful caboose,” Brady said on the FOX broadcast.

When Brady’s colleague, Kevin Burkhardt, said that Allen would take that as a compliment, Brady admitted that he had caboose envy.

“I wish I had one (like Allen),” Brady added. “I didn’t have much of one. I tried to wormhole that thing through there (on quarterback sneaks), but Josh has all the power.”

Allen has a lot of catching up to do if he ever wants to be considered in Brady’s class, but at least he has an MVC (Most Valuable Caboose) that Brady is envious about post-career.
