ALBANY — The man who killed a pedestrian while driving drunk was sentenced Tuesday to five to 15 years in state prison, Albany County prosecutors said.
In January, Jose Guevara-Bonilla, 27, of Albany, pleaded guilty to aggravated vehicular homicide. On Oct. 24, he lost control of his car, went onto the sidewalk and hit Larry Cunningham, 62, of Albany. He kept driving; Cunningham was found dying on the sidewalk. The crash happened on Third Avenue in Albany, the district attorney’s office said.
Cunningham’s uncle, Fred Thomas, said Cunningham’s death “left a void in his family’s life.”
“The family hopes and prays that Mr. Jose Guevara-Bonilla realizes that he is leaving the family of Larry Cunningham mourning with the painful memory of his untimely death for the rest of their lives. We can only hope that the judiciary system will make sure that this does not happen to another person,” he said, according to a news release from the district attorney.
Cunningham died at the scene. A detective saw the crash and pursued Guevara-Bonilla, who was arrested.
Crash investigators determined Guevara-Bonilla was headed east on Third Avenue and speeding when he lost control of his vehicle and went onto the sidewalk, hitting Cunningham, police said. In addition to the prison sentence, Guevara-Bonilla’s driver’s license will be revoked.
