eBay-owned TCGplayer and union settle unfair labor practice charges

Syracuse, N.Y. — The National Labor Relations Board has approved a settlement of unfair labor practice charges filed last year by the union representing workers at eBay-owned TCGplayer in Syracuse.

The Communications Workers of America said Tuesday the settlement includes โ€œsignificantโ€ payments TCGplayer will make to two former workers, Iris St. Lucy and Gabriel Brasie, who the union alleged were unlawfully fired by the company.

โ€œIโ€™m elated that TCGplayer and eBay are being held accountable for their decision to terminate me, which has been a substantial financial burden on me for the last year,โ€ St. Lucy, a former generalist at TCGplayer, said in a statement.

The union alleged in an unfair labor practice charge last year that Lucy was unlawfully fired for helping to organize a successful union drive at the company.

The CWA also alleged that Brasie was unlawfully fired due to changes the company made to his job requirements without the benefit of collective bargaining.

The amount of the payments to the two workers will remain confidential under the terms of the settlement, the union said. It said the settlement also requires the company to compensate other workers for sick pay they lost due to a unilateral change the company made to its policies.

The settlement also covers CWAโ€™s charges that TCGplayer and eBay:

  • Refused to recognize and bargain with the union
  • Denied workers their right to union representation in meetings
  • Threatened to discipline union workers more harshly than others
  • Unlawfully changed the terms and conditions of employment without first bargaining with the union

In a statement, TCGplayer said the company and the union have resolved all pending unfair labor practice charges.

โ€œImportantly, the NLRB did not find that TCGplayer violated the law nor did it find that TCGplayer failed to meet any of its obligations under the National Labor Relations Act,โ€ the company said.
