City of Geneva responds to lawsuit, cites no seat belt in accident

In a recent legal development, the City of Geneva, along with its Police Department and Detective Steve Vine, have responded to a lawsuit filed by John Sweet, arguing that Sweetโ€™s injuries from a last yearโ€™s crash were due to not wearing a seat belt. The accident occurred on March 24, 2023, at an intersection with flashing red lights, involving a police vehicle driven by Det. Vine and Sweetโ€™s vehicle.

The cityโ€™s defense, articulated by Attorney Joseph Rizzo, challenges the severity of Sweetโ€™s injuries claimed in the lawsuit, suggesting that proper seat belt use could have mitigated or prevented them. This response comes after Sweet accused Det. Vine of behavior leading to his โ€œsevere and permanentโ€ injuries.

This case has garnered attention as it proceeds without specified monetary damages, raising discussions on safety and responsibility. The accident report, obtained through a Freedom of Information Law request, noted no injuries at the scene and mentioned that Sweet had the right-of-way, adding complexity to the ongoing legal battle.
