ALBANY- A new credit card surcharge disclosure law goes into effect today (Sunday) that requires businesses that impose a credit card surcharge to post the total price of the transaction, including the surcharge, before sale.ย The new law was signed by Governor Kathy Hochul in December 2023.
โNew Yorkers should never have to deal with hidden credit card costs, and this law will ensure individuals can trust that their purchases will not result in surprise surcharges,โ Hochul said.
The new law requires that credit card surcharges are limited to the amount charged to the business by the credit card company.ย It also requires that businesses post, before checkout, the total price of an item or service inclusive of the credit card surcharge or offer a two-tiered pricing option, which requires the credit card price to be posted alongside the cash price.
โTransparency is crucial in building trust between businesses and communities and now patrons will be empowered to budget accordingly,โ concluded Hochul.
The new law does not apply to debit cards.
