Man charged after being shot by police (VIDEO)

POUGHKEEPSIE – An armed Poughkeepsie city resident who was shot by police on Sunday night after pointing a gun at officers has been charged with two felonies.

City of Poughkeepsie Police Chief Tom Pape told Mid-Hudson News that a city dispatcher received a report of a man with a gun in his waistband was walking around Main Street, yelling at people just before 8 p.m.  The officers were provided a description of the suspect, now identified as Leopoldo Duartepalacios, 37, and located him in the area of 622 Main Street, where several people were dining outside at the restaurant at that address.

Officers made contact with the man, Pape said, and a struggle ensued.

“During that struggle the perpetrator pulled out a weapon, pointed it at one of the officers, and a second officer on the scene discharged his weapon to neutralize the threat,” he said.

Chief Pape said the entire interaction lasted “just a few seconds.”

Once the suspect was shot and wounded, he was taken into custody by police who began life-saving measures on the suspect.  “Immediate measures to neutralize any ill-effects of the gunshot were done,” Pape said.  “A tourniquet was applied to the suspect – obviously EMS was called for.”  The suspect was transported to the hospital for treatment, as were the officers involved in the shooting.  “We know the outcome from there,” Chief Pape said.

After being released from the hospital, Duartepalacios was transported to police headquarters and subsequently arraigned on the felony charges of menacing a police officer and criminal possession of a weapon.  He was remanded to the Dutchess County Jail in lieu of $20,000 cash bail, $40,000 bond, or $80,000 partially secured bond.

The officers involved in the incident have been placed on administrative leave during the investigation, pursuant to department policy.
