Property owners group plans to sue Newburgh over Emergency Tenant Protection Act designation

NEWBURGH – The Hudson Valley Property Owners Association plans to sue the City of Newburgh over its declaration that it qualifies for renter protection under the Emergency Tenant Protection Act.

In order to opt into the program, a community must prove that its vacancy rate is under five percent and Executive Director Rich Lanzarone said Newburgh’s calculations were wrong.

“The vacancy study they based the resolution on was defective . It contained multiple mistakes. They were informed in advance of the mistakes; they went ahead anyway,” he said. “When you correct the mistakes it brings the vacancy rate to above five percent, at least 6.35 percent.”

Lanzarone said his organization plans to file an Article 78 proceeding challenging the city’s decision in Orange County State Supreme Court.

The landlords’ group is currently in court challenging the City of Kingston’s similar designation.
