Buffalo man pleads guilty to reckless driving in hit-and-run accident in Cheektowaga

A Buffalo man pleaded guilty to a charge of reckless driving for severely injuring a Depew man, Erie County District Attorney John J. Flynn said in a press release. He entered his plea beforeย Erie County Court Judge Sheila A. DiTullioย one day before jury selection was to begin for a trial.ย 

Timothy M. Wagner, 29, was driving a pickup truck around 7:50 a.m. on April 19, 2021, eastbound on Losson Road in Cheektowaga when he struck a pedestrian from behind near Wedgewood Drive, prosecutors said.ย 

The impact left the pedestrian,ย a 60-year-old man from Depew, face down on the ground while Wagner fled the scene without reporting the incident to the police, officials added.ย 

Later that day, the Cheektowaga police found his vehicle with front-end damage that matched the description of the hit-run vehicle.ย 

The victim was rushed to the hospital and underwent multiple surgeries for his injuries. Prosecutors said that he consented to Wagner’s plea to a reduced charge.ย 

Wagner is scheduled to be sentenced June 20 on the charge, an unclassified misdemeanor under state Vehicle and Traffic Law, and faces a maximum of 30 days in jail.ย
