GOSHEN – An Orange County Court jury Tuesday convicted a Newburgh man on charges of weapons possession and tampering with physical evidence. This was the second trial on the charges against Robert Jemerson, 19, after a previous trial in May resulted in a deadlocked jury.
It was alleged that on September 8, 2022, Newburgh City and State Police conducted a vehicle and traffic stop in the area of Downing Park in Newburgh.
After the vehicle was stopped, Jemerson, who was a passenger, fled and ran toward the pond at the park. While running, he threw a loaded .38 caliber revolver into the pond and then jumped in. Police had to rescue him from drowning.
Later, police drained the pond and recovered the firearm Jemerson was seen tossing in the water. It was later tested and found to be operational.
When sentenced in September, he is expected to be sentenced in September and could receive a maximum prison term of 15 years.
“Getting dangerous and illegally possessed guns off of our streets in a shared priority of police and prosecutors,” said District Attorney David Hoovler.
