KINGSTON – Nickolas Torres, serving a prison term for a terrifying home invasion where he and two associates broke into his ex-girlfriend’s house, appealed his 18-year prison sentence.
Torres, known as “Slick,” pled guilty to felony burglary in 2016 in Ulster County Court. The plea agreement was the result of negotiations between the District Attorney’s Office and the defense team.
Facing a 23-count indictment, Torres, 22 at the time, pled guilty to burglary and waived his right to appeal upon the understanding that he would receive a sentence of no more than 18 years in prison and five years of post-release supervision.
At the time, the Ulster County Court judge allowed Torres to ask for a lesser sentence but told him that it would be an unsuccessful argument. Torres admitted in court that he was aware he was likely to receive the 18-year sentence before entering the plea.
Now that he is in prison, he is appealing the length of the sentence.
In a July 27, 2023 decision, the state appellate court denied the appeal, saying in part, “The fact remains that defendant received the sentence that he knew he would likely receive when he pleaded guilty, and we would therefore perceive no reason to disturb that sentence.”
Torres is currently housed in the Elmira Correctional Facility. His earliest release date is June 10, 2031.
