POUGHKEEPSIE – Schenectady resident Kenneth Simmons was sentenced in Dutchess County Court to six years in prison on Friday for his role in a robbery that occurred in Fishkill in October of last year. The 19-year-old felon is the last of three participants to be sentenced. In addition to his prison time, Simmons will serve five years of post-release supervision.
Simmons entered a guilty plea to robbery in March. He was being prosecuted by Dutchess County Senior Assistant District Attorney Scott Johnson and represented by Poughkeepsie-based attorney Ken Pritchard.
Simmons joined Schenectady resident Richard Lee, 23, and Lee’s lover, Luz Resto, in robbing Resto’s husband of cash and an iPhone while also beating him and slashing his face and arms with scissors.
When the getaway vehicle, driven by Resto, was stopped minutes after the robbery, she was sitting on the cash stolen from her husband. Simmons was in possession of the cell phone. The scissors used in the attack were also recovered.
Dutchess County Court Judge Edward McLoughlin noted that Simmons was not the primary assailant in the attack and was considered “hired help” for his role in the robbery.
Richard Lee was sentenced to 10 years in prison and five years of post-release supervision in March of this year.
Luz Resto orchestrated the robbery of her husband. She pled guilty to robbery in February and was sentenced to five years in prison and five years of post-release supervision.
